What Is a 510(k) and Why Does It Exist?

The 510(k) takes its name from Section 510(k) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 360(k), https://www.law.cornell.edu/uscode/text/21/360). The statute requires device manufacturers to notify the FDA at least 90 days before marketing a device, giving the agency time to determine whether the device requires premarket approval (PMA) or can reach the market via the substantial equivalence pathway.

The premise of the 510(k) is comparative, not absolute. The FDA does not independently evaluate whether your device is safe and effective in an absolute sense. What Goes Into a 510(k) Submission

Device description. A clear, specific description of the device: what it is, how it works, the materials, the components, and any accessories. Accompanying photographs, schematics, or engineering drawings are standard.

Intended use and indications for use. These two terms are related but distinct in FDA terminology. Intended use is broader: what the device does and the patient population it serves. Indications for use is more specific: the conditions, diseases, or patient characteristics the device is indicated to diagnose, treat, prevent, or mitigate. The indications for use statement in the 510(k) becomes the foundation of your cleared labeling, and therefore the boundary of your marketing claims.

Predicate identification. A 510(k) must identify at least one predicate device: a legally marketed device to which substantial equivalence is being claimed. The predicate must have the same intended use and the same, or different but not affecting safety or effectiveness, technological characteristics as the new device. Substantial equivalence comparison. A structured comparison of the new device to the predicate across intended use and technological characteristics. The Review Timeline: What Happens After Submission

The FDA's review process follows a structured sequence. Understanding it helps you build a realistic pre-launch timeline.

Acceptance review (Day 1 to 15). The FDA conducts an initial completeness check within 15 calendar days of receipt. Substantial equivalence decision. At the end of review, the FDA issues one of three decisions: (1) substantially equivalent (SE), meaning the device is cleared; (2) not substantially equivalent (NSE), meaning the device cannot enter commerce under this 510(k); or (3) an AI request for additional information. An NSE decision can be appealed administratively and, ultimately, to the courts.

What Clearance Means for Your Marketing Program

510(k) clearance is marketing authorization for the device as submitted. Three things follow from that.

The cleared indications are the boundary of your claims. Every marketing claim about what the device does, who it benefits, and what conditions it treats must stay within the indications for use as cleared. Going outside those indications in promotional materials can establish a new intended use under FDA's traditional analysis, which can render the device misbranded or require a new 510(k).
